Privacy and HIPAA Policy for Clinicians

These provisions may be changed from time to time and without notice, at The Gottman Institute’s sole discretion and as provided by applicable law. You should check this Privacy Policy frequently for any such changes, but in any case Your continued access or use of the Site shall constitute acceptance of any modifications of the Privacy Policy. The Gottman Institute’s use of information gathered or obtained now is subject to the Privacy Policy in effect at the time of such use.The following provisions apply to information The Gottman Institute learns about or obtains from You when You visit The Gottman Institute Relationship Checkup Web site (the “Site”). Your access or use of the Site constitutes Your legally binding acceptance of and agreement to this Privacy Policy. Definitions contained in the Site’s Terms shall apply to this Privacy Policy as well.

Security: The Site has security measures in place to protect against the loss, misuse or alteration of information under The Gottman Institute’s control.

Compliance with COPPA: The Site is not directed at children under the age of 18. The Gottman Institute complies with the Children’s Online Privacy Protection Act and does not knowingly permit submission of Personal Information by anyone under 18 years of age.

Subpoenas: The Gottman Institute does not disclose the identities of visitors or users of the Site unless legally required to do so. Unless specifically prohibited from doing so by law or court order, we will give prior notice to any named party in a subpoena received by us from a government agency or private party requiring us to disclose your name or any of your protected health information before making such disclosure.

Correct/Update Procedure: If You want to delete or modify Your Personal Information or Automated Information from The Gottman Institute’s records, You may do so by:

HIPAA: At the beginning of therapy, U.S. Federal HIPAA law requires that you as a "covered entity" present your clients with a notice of privacy policies similar to that presented in this document. Please be sure that you present these policies and obtain signatures from both partners in the couple prior to proceeding with therapy.

HOW WE USE YOUR INFORMATION

Here is the information we collect and how we use it:

• We store your name for the purpose of identifying you to your clients.
• We store your email for the purpose of identifying you to the Site and notifying you about completed assessments.
• We store an encrypted version of your password so that you may verify your identity.
• We store the names, emails, and encrypted passwords of your clients so that they can be identified and receive an invitation to the Site.
• We collect analytics with Google Analytics to measure site traffic and usage. You may opt out of Google Analytics.
• We gather demographic data from your clients such as birthdate, occupation, and marital status. The demographic data is used in aggregate for anonymized, deidentified statistical research purposes. Providing demographic data is optional for your clients and not required for them to use the Checkup.
• We collect location data such as country, state, and ZIP code if you are paying for the Checkup yourself. Location data is collected for the purpose of charging sales tax only to Washington state residents. We gather the same data from your clients if they are paying.
• We store your clients' responses to the questionnaire and share them only with you. Their answers generate a suggested treatment plan shared only with you.
• We anonymize and de-identify your clients' answers also for the purposes of research to improve the overall evidence-based methodologies of the assessment.
